1. Introduction and Acceptance
Welcome to UsizoClaims. These Terms of Service ("Terms", "Agreement") govern your access to and use of the website, mobile services, software, and tools provided by UsizoClaims (Pty) Ltd (Registration Number: 2026/766240/07), operating at https://usizoclaims.com (the "Platform").
By registering an account, submitting an accident assessment form, purchasing an optional dashboard upgrade, subscribing to an attorney membership tier, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Refund Policy, and Cancellation Policy. If you do not agree, you must immediately discontinue use of the Platform.
2. Critical Legal Disclaimers & Independent Nature
PLEASE READ THIS SECTION CAREFULLY BEFORE USING ANY USIZOCLAIMS SERVICE:
- Independent Technology Platform: UsizoClaims (Pty) Ltd is a privately owned technology and administrative enablement platform. We are NOT affiliated with, endorsed by, or connected to the Road Accident Fund (RAF), the Department of Transport, or any other South African organ of state.
- Not a Law Firm: UsizoClaims is not an attorney practice, law firm, or legal services provider. We do not render legal advice, formal representation, or litigation services.
- No Attorney-Client Relationship: Interacting with our website, completing our digital accident questionnaire, or utilizing our AI claim calculator does not create an attorney-client relationship.
- No Guarantees: Any estimated claim strength, quantum ranges, or merit indicators generated by the platform are indicative, educational estimates only. We do not guarantee that your claim will be accepted by the RAF, that any attorney will agree to take your case, or that any financial compensation will be awarded.
- Independent Legal Counsel: Users are explicitly advised to consult an independent, qualified legal practitioner registered with the Legal Practice Council (LPC) for formal legal representation and advice.
3. Service Tiers & Free Assessment Access
UsizoClaims operates under a two-sided platform architecture serving accident claimants and legal practitioners under distinct commercial terms:
3.1 Claimant Services (Accident Victims)
- Free Assessment & Basic Outcome: RAF accident registration, multi-step claim questionnaire completion, basic merit evaluation, and initial indicative assessment outcomes are 100% free of charge for all claimants. Payment is never required to complete an accident assessment or receive the basic result.
- Optional Dashboard Upgrade (R200 Once-Off): Claimants may voluntarily elect to purchase an optional one-time dashboard upgrade (R200 ZAR). This optional upgrade unlocks comprehensive self-service management tools, statutory document checklists, case dossier organization tools, and direct access to our qualified attorney directory. Opting out of the R200 upgrade does not impair or block the free initial evaluation.
3.2 Legal Practitioner / Attorney Subscriptions
Qualified attorneys and law firms registered with the Legal Practice Council (LPC) may subscribe to monthly membership plans to receive qualified, structured claimant leads and access dossier review tools. Approved plans include:
- Starter: R5,000 / month (ZAR), up to 5 allocated leads per month.
- Professional: R10,000 / month (ZAR), up to 12 allocated leads per month.
- Premium: R20,000 / month (ZAR), up to 30 allocated leads per month.
- Elite: R30,000 / month (ZAR), up to 50 allocated leads per month.
- Pay-Per-Lead (Optional): R150 once-off per individual extra lead unlock.
4. Billing, Payments, and Automatic Renewal
- Currency: All fees are stated and processed in South African Rand (ZAR).
- Payment Gateway: All credit card, debit card, EFT, and recurring debit orders are processed through our authorized payment partner, Paystack Payments (Pty) Ltd. UsizoClaims does not store full credit card numbers or banking credentials.
- Billing Frequency & Automatic Renewal: Attorney membership plans are billed on a monthly recurring basis. Subscriptions automatically renew on the monthly anniversary date unless cancelled prior to the billing date through the Attorney Dashboard.
- Lead Quota Allocation: Monthly lead quotas reset on each billing cycle. Unused lead allocations do not accumulate or carry forward to subsequent billing periods.
- Value-Added Tax (VAT): VAT at the statutory South African rate of 15% applies where required by law. Invoices reflecting the statutory tax breakdown are generated in the user dashboard.
5. Cancellations and Refunds
Please review our dedicated Cancellation Policy and Refund Policy for full details.
- Attorneys may cancel their subscription at any time via the Attorney Dashboard under Subscription Settings. Cancellation halts future billings, and access continues through the paid period.
- Fees for services already consumed, allocated leads, unlocked dossier contacts, or partially utilized billing cycles are non-refundable, except as mandated by the Consumer Protection Act (CPA) No. 68 of 2008 or the Electronic Communications and Transactions Act (ECTA) No. 25 of 2002.
6. User Obligations and Accurate Information
You agree to provide true, accurate, current, and complete information when creating an account or submitting accident details. Submitting fraudulent claims, falsified police reports, or misleading medical documentation is strictly prohibited and constitutes a criminal offense under South African law. We reserve the right to suspend or terminate any account suspected of deceptive or unlawful activity.
7. Data Protection & POPIA Compliance
UsizoClaims (Pty) Ltd processes all personal and special personal information in strict compliance with the Protection of Personal Information Act (POPIA) No. 4 of 2013. For full disclosures on data security, retention, and your rights as a data subject, please refer to our Privacy Policy.
8. Intellectual Property
All content, source code, logos, trademarks, workflows, algorithms, and interface designs on the Platform are the exclusive property of UsizoClaims (Pty) Ltd or its licensors and are protected under South African and international intellectual property laws.
9. Limitation of Liability
To the maximum extent permitted under applicable South African legislation, UsizoClaims (Pty) Ltd, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) your use of or inability to use the Platform; (b) any outcome, delay, or rejection of a claim submitted to the Road Accident Fund; (c) the acts, omissions, or conduct of any independent attorney connected via the Platform; or (d) unauthorized access to or alteration of your transmissions or data.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the High Court of South Africa in respect of any disputes arising out of or in connection with these Terms.
11. Amendments
We reserve the right to modify these Terms at any time. When modifications are made, the updated version will be posted on this page with an updated "Effective Date". Continued use of the Platform after such changes constitutes acceptance of the amended Terms.
